TERMS AND CONDITIONS:
By using the services of Royal Bloodstock, and accessing the content of www.royalbloodstock.com and www.royalbloodstock.com.au ( “the websites” ) you agree to be bound by the terms and conditions set out herein.
WARRANTIES – ALL SALES TERMS
Royal Bloodstock, acting as Agent, offers the details of these horses in good faith but cannot guarantee or warrant the accuracy or exclusion of any information nor warrant the condition of any horse. We strongly recommend that a buyer procure an independent vet examination after an offer is accepted and prior to exchange of funds. These horses are offered subject to prior sale, price change, or withdrawal without notice. Photos may not properly reflect the current condition of the actual horse offered for sale. In some cases the horses racing photos or stallion photographs may be used. All accepted offers need to be finalised within 72 hours, unless prior permission has been received in writing. Charges may be applicable after this time.
TRANSFER OF OWNERSHIP:
The managing Owner / Trainer must have permission from all owners to put a horse up for sale.
The price Royal Bloodstock presents to the ‘seller’ will be inclusive of any GST.
Royal Bloodstock will pay the “seller” (Managing Owner or Trainer) of the horse the total purchase price less commission within 24 hours of receiving completed transfer documents relating to the “horse”. Signed Transfer Documents will need to be received by our Office (or the Purchaser) before payment is transferred.
Royal Bloodstock will endeavor to have all necessary sales documents to the Purchaser within 14 days, however Royal Bloodstock will under no circumstances, be liable for indirect, special, or consequential damages including any loss of business, revenue or profits due to any delay in receiving these documents. The “horse” and title will be transferred to the purchaser as soon as funds have been received in full by our office.
BUYERS AGENT
Royal Bloodstock, as Agent, makes offer’s on behalf of our client in good faith, we do not guarantee or warrant the accepted price if our client (the Purchaser) cancels the sale for any reason.
COMMISSION
(as at the 01/01/2016) 10% up to $50,000.00 AUD and 5% for any value thereafter. Eg/ a $100,000.00 sale will incur a commission of $7500.00 plus GST. Minimum commission rate is $300.00 plus GST. A 5% Surcharge is applicable to non-exclusive listings. An exclusive listing is where authority is given to promote the “horse” on an exclusive basis for 21 days. If sold elsewhere within that period, commission is payable, based on the set exclusive rate.
DISCLAIMER
The particulars of all horses are provided by the respective vendors who are solely responsible for the particulars and their accuracy. Potential purchasers are advised carefully to examine all documents including stud books and form records, and to take professional veterinary advice before entering into a contract to purchase.
Potential purchasers are also advised to satisfy themselves that the person offering the horse for sale is the owner of the horse or his appointed representative or agent, and that the horse is sold with clear title free from liens and encumbrances (for example purchasers of in-foal mares should confirm that there are no outstanding fees or stud expenses relating to the mare).
Royal Bloodstock will make every effort to publish details and particulars as received but accepts no responsibility for errors or omissions. Vendors are advised to part with possession of their horses or confer title on a purchaser only upon confirmation of receipt of cleared funds.
Royal Bloodstock acts “as Agent” and has no ownership of the Stock it advertises.
Royal Bloodstock will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the website and/or services, advice or recommendations provided by Geegees Pty Ltd t/a Royal Bloodstock and its employee’s.
THIRD PARTY SERVICES
On behalf of the Purchaser, Geegees Pty Ltd T/A Royal Bloodstock are able to organise Vetting, Transport, Spelling, Insurance, Farrier or any other third party service. This is offered as a courtesy and we do not accept liability for any injury to the horse/s that may arise due to these services being provided nor make any guarantee or warrant these services providers in any way. We always endeavour to utilise an independent Veterinarian but depending on horse location, this is sometimes not feasible. Royal Bloodstock does not charge commission on third party services.
Any information is provided on the understanding that the website and other media provided by Royal Bloodstock are not engaged in rendering advice and should not be wholly relied upon when making any related decision.
